3 . Regulatory Requirements.
3 .1 The offeror / contractor is encouraged to use recovered materials in accordance with paragraph 23.403 of the Federal Acquisition Regulation (FAR).
3.2 Certification. The contractor shall certify that if polystyrene is used in the manufacture of this item, it shall contain a minimum of 25 percent of Postconsumer Recovered Materials in accordance with the 40 Code of Federal Regulations Part 247, Comprehensive Guidelines for Procurement of Products Containing Recovered Material; Final Rule. The Government reserves the right to require proof of such conformance prior to first delivery and thereafter as may be otherwise provided for under the provisions of the contract.
4 . QUALITY ASSURANCE PROVISIONS:
4.1 Contractor Certification. The contractor shall certify and maintain substantial evidence that product offered meets the salien characteristic of this Commercial Item Description, and that the product conforms to the Producer’s own drawings, specifications, standards and quality assurance practices. The government reserve the right to require proof of such conformance prior to first delivery and thereafter as may be otherwise provided for under the provision of the contract.
4.2 Suppliers are encouraged to use quality control (QC) techniques that exhibits control over their processes (e.g. Statistical process Control). These techniques shall ensure quality levels equal to, or greater than, those cited in the applicable technical document or herein. For those product characteristics which are controlled by such a method, requirements for end item inspection or test may be considered to have been met. End item inspection / testing may be used by the offeror, or the Government representative, as a means to determine the effectiveness of the inprocess quality controls. In process controls shall not be substituted for end item performance testing, unless it can be demonstrated that there exists a direct correlation between the process and product performance, such that end item performance testing is obviated.
For those characteristics for which there are no such controls, or for end item performance test, lot by lot sampling for inspection / shall be required. Sampling shall be in accordance with the American National Standards Institute (ANSI) / American Society of Quality Control (ASQC) ANSI/ASQC 21.4 1993, Sampling Procedure and Tables for Inspection by Attributes.
